Dubey, giving a big statement, said that ‘Supreme Court is responsible for inciting religious war in the country’. He accused the Supreme Court of weakening the sovereignty of Parliament and making laws out of his limits. Dubey said that if the Supreme Court has to make a law, then Parliament and Legislative Assembly should be closed ‘. BJP MP Nishikant Dubey said, ‘The Supreme Court is responsible for inciting religious war in the country. The Supreme Court is going out of its limits. If you have to go to the Supreme Court for everything, then Parliament and Assembly have no meaning, it should be closed. How can you give instructions to the Opportunity Authority? The President appoints the Chief Justice of India. Parliament enacts the law of this country. How did you make a new law? In which law it is written that the President has to decide within 3 months? This means that you want to take this country towards anarchy. When Parliament is seated, there will be a detailed discussion on it.
These instructions of Supreme Court are in discussion
Explain that recently the Supreme Court had directed the President to take a decision on the bills sent by the governors within 3 months. This decision came in the Tamil Nadu vs. Governor case on 8 April 2025, in which the Supreme Court has given Governor R.N. The delay on Ravi’s bills was held unconstitutional. Apart from this, the Supreme Court issued an interim order on the Waqf (Amendment) Act on 15 April 2025. Also, the court issued a notice to the Central Government on some provisions of this law. Explain that the law was passed by Parliament, which was aimed at improving the management and transparency of Waqf properties.
Vice President Dhankhar had expressed concern
Explain that on 17 April 2025, Vice President Jagdeep Dhankhar termed the instructions given in the Tamil Nadu vs. Governor case of the Supreme Court as ‘judicial encroachment’. Dhankhar had said, ‘We cannot keep a situation where the Supreme Court gives instructions to the President. The court has the right to explain the constitution, but cannot play the role of executive or legislature. Describing Article 142 as ’24×7 available nuclear missiles for the judiciary’, he expressed concern over its unlimited power.
