New Delhi. Delhi CM Arvind Kejriwal had filed an application against his arrest in the Delhi High Court. Justice Swarnakanta Sharma of Delhi High Court refused to grant relief to Kejriwal. Apart from this, Justice Swarnakanta Sharma has also written such a thing in her decision, due to which the Aam Aadmi Party is also in trouble.
Rejecting Arvind Kejriwal’s application, Delhi High Court has said in its decision that political parties also come under the purview of Section 70 of the PMLA Act. The High Court has given the reason for this that a political party is also a group of people like a company. With this decision of Delhi High Court, all political parties including Aam Aadmi Party have been brought under the definition of money laundering. Now ED can also make Aam Aadmi Party a party in the liquor scam case.
Section 70 of PMLA states that whenever a company commits money laundering, every person who was watching the company at that time will also be considered guilty and action will be taken. Section 70 of PMLA also covers groups of individuals along with registered companies. During the hearing of Arvind Kejriwal’s petition in Delhi High Court, ED has said that Aam Aadmi Party has also benefited from the liquor scam. According to ED, Aam Aadmi Party has also committed a crime. Earlier in October 2023, during the hearing of the liquor scam case, the Supreme Court had asked the ED that if the Aam Aadmi Party benefited in this case, then why was it not made an accused. In such a situation, the way Delhi High Court has interpreted Section 70 of PMLA, it seems that a crisis is brewing for the Aam Aadmi Party as well.
