Divorce provision in Hindu Marriage Act
In fact, the wife had opposed the decision of the Family Court in the High Court. The family court had allowed the husband’s request for divorce from his wife. The husband had appealed to the Family Court for divorce under Section 13(1)(ia) of the Hindu Marriage Act, 1956. Under this section, there is a provision for divorce on the ground of cruelty.
The High Court also agreed – the wife is very cruel
When the wife opposed the decision of the Family Court in the High Court, she was disappointed there too. The High Court said on the statements of the woman that her behavior towards her husband was very cruel. The High Court accepted the observations of the Family Court as correct. The Family Court had said that the woman behaves cruelly with her husband and says obscene things to the husband as well as his parents.
Abusive wife also got a shock from the High Court
The High Court said that the evidence of cruelty to the woman has been found and it is sufficient to satisfy the conditions required under Section 13(1)(ia) of the Hindu Marriage Act. The division bench of the High Court said, ‘Therefore, we consider the decision of the Family Court to allow the petition for divorce on the ground of cruelty justified. Also, we do not see any merit in the petition on behalf of the woman. Hence it is rejected.
