Patna. After the results of the caste survey in Bihar, CM Nitish Kumar had introduced a bill in the Assembly to increase the reservation limit to 65 percent. This law has also been approved by the Governor, but the matter is stuck in the court. The law to increase reservation in Bihar has been challenged in the Patna High Court. Gaurav Kumar and Naman Shrestha have filed this application in Patna High Court against increasing the reservation. Both have challenged its constitutional validity and have appealed to immediately ban it. On November 10 itself, Nitish Kumar’s government had passed the Bihar Reservation (For Scheduled Castes, Tribes and Other Backward Classes) Amendment Act 2023 and the Bihar (Admission in Educational Institutions) Reservation Amendment Act in the Assembly. The Governor approved it on 18 November.
Actually, there is an old decision of the Constitution Bench of the Supreme Court that more than 50 percent reservation cannot be given. Yes, quota can be given within the quota. Under this, the limit of 50 percent has been maintained in all the states by giving reservation under the quota, but in Bihar, due to the above two laws passed by the Nitish government, the reservation should be 65 percent i.e. 15 percent more than the fixed quota. Has gone. This has been challenged in the Patna High Court. Anyway, questions are being raised on the results of the caste survey based on which the Nitish government passed the law to increase reservation. In the results of this caste survey, it was told that there are more Muslims and Yadavs in Bihar. At the same time, extremely backward is also 36 percent. Leaders of all political parties and common people have raised questions on this result.
Many of the common people also alleged that during the caste survey, no government official or employee reached their homes. Whereas, the government says that the results of the caste survey have been announced only after taking data from every household. First the caste survey was also challenged in the Patna High Court and then in the Supreme Court. This survey was not banned in both the courts. Now everyone’s eyes are on what stand the court takes on the law to increase reservation.
