New Delhi. The Center on Monday moved the Supreme Court requesting amendment in the decision related to 2G spectrum case after more than 12 years. The court had said in its decision that the government is bound to adopt the auction route while transferring the country’s natural resources. In its decision of February 2, 2012, A. was appointed as Telecom Minister in January 2008. During Raja’s tenure, 2G spectrum licenses given to various companies were cancelled.
Attorney General R, appearing for the Centre. Venkataramani told Chief Justice D.Y. Chandrachud and Justice J.B. Mentioned an interim application before Pardiwala’s bench. Urging immediate listing of the application, the top law officer told the bench that the petition seeks modification of the 2012 judgment as the Center wants to grant 2G spectrum licenses in certain cases. The Chief Justice told Venkataramani, ‘We will see, please send an e-mail.’
Advocate Prashant Bhushan, appearing for NGO ‘Centre for Public Interest Litigation’, opposed the application and said the issue had been well resolved by the apex court in its decision regarding the auction. The concerned NGO was among the petitioners on whose petitions the court gave its decision in February 2012. On March 22 this year, the Delhi High Court had accepted the Central Bureau of Investigation’s (CBI) appeal against the acquittal of Raja and 16 others in the 2G spectrum allocation case, allowing the case to be heard six years after the agency filed the plea. The path was paved.
Accepting the CBI’s appeal, the High Court had said that there were ‘some contradictions’ in the lower court’s decision which required ‘thorough investigation’. The special court had on December 21, 2017, acquitted Raja, DMK MP Kanimozhi and others in the CBI and Enforcement Directorate (ED) cases related to 2G spectrum allocation. On March 20, 2018, CBI had approached the High Court challenging the decision of the special court. The agency had alleged that the exchequer had suffered a loss of Rs 30,984 crore due to the license allocation process for 2G spectrum.
