The Delhi High Court on Tuesday issued fresh notices on petitions seeking to implicate various politicians and others on charges of hate speech related to the anti-Citizenship Amendment Act (CAA) protests during the 2020 Delhi riots. The names of Congress leaders Sonia Gandhi, Priyanka Gandhi Vadra, Rahul Gandhi, BJP leaders Anurag Thakur, Parvesh Sahib Verma, Kapil Mishra and others are included in the list.
However, while issuing the notice, a division bench headed by Justice Siddharth Mridul and Justice Rajneesh Bhatnagar observed that those who are in the list are only the proposed respondents and not the accused persons.
It clarified that the reply has been sought as the petitioner has leveled the allegations against him. The bench was dealing with a slew of arguments related to hate speeches that had allegedly fueled the riots in the national capital.
Earlier, a division bench of Justice Siddharth Mridul and Justice Anoop Kumar Mendiratta had sought replies from the proposed respondents to ascertain whether they should be added or not.
During the hearing, the bench said that they cannot be implicated if there is a protest.
In one of the petitions, the petitioner Mujtaba sought to implicate Bharatiya Janata Party (BJP) leaders Kapil Mishra, Anurag Thakur, Parvesh Verma and Abhay Verma as defendants, while the voice of lawyers sought to implicate 20 people.
These 20 include Sonia Gandhi, Rahul Gandhi, Priyanka Gandhi, Manish Sisodia, Amanatullah Khan, Waris Pathan, Akbaruddin Owaisi, Mehmood Pracha, Harsh Mander, Mufti Mohammad Ismail, Swara Bhaskar, Umar Khalid, Maulana Habib ur Rehman, Mohammad Dilwar, Maulana Shreyer Raza, Maulana Hammood Raza, Maulana Tauqeer, Faizul Hasan, Tauqir Raza Khan and B.G. Kolse Patil is involved.
