Kashmiri businessman Zahoor Watali, arrested by the National Investigation Agency (NIA) in 2017 in a terrorism financing case, has been released from jail for treatment of an incurable disease and put under house arrest. In early February itself, the special NIA court had rejected Zahoor Watali’s application for regular bail. However, in view of his illness, the special court has allowed him to continue his treatment from home in judicial custody.
While hearing Watali’s bail plea, the special NIA court said that it has already been rejected by the Supreme Court. Taking into account the advice of doctors from a private hospital as well as AIIMS, the court said that Watali can be taken home till further orders. From here they will be allowed to go to the hospital for their treatment or to the diagnostic center for tests. The special NIA court said that during the period of detention of the accused, no one except his family members and lawyer is allowed to visit the accused. will be given.
The judge said that the accused is old and his health condition is critical and he needs immediate medical attention as well as assistance for his daily activities, which require him to be out of jail, but the gravity of the offence. prevents me from giving him regular bail. On this, the counsel for accused Zahoor Watali argued that while in detention Watali’s grandsons would form an adverse opinion about him as they did not know that he was in custody. Understanding the concern expressed by the accused, the judge said that the children have to face the truth.
Notably, the NIA had arrested Watali in August 2017 for his alleged involvement in the Jammu and Kashmir terror financing case.
