Gwalior Court News: Gwalior. New Zealand Representative. The Mawa trader got a big relief from the District and Sessions Court. The Food Department had imposed a fine of Rs 3 lakh on the trader, which was reduced to 35 thousand by the court. The court said that this is not fair. The adjudicating officer did not take into account the facts while imposing the fine.
On July 21, 2019, the Food Department team raided the shop of Mayank Singhal in Peacock Bazar. Here Mawa was kept for human sale. Introducing themselves, the officers of the department took samples of mawa. Sealed the samples and prepared Panchnama. Sent to the lab for testing. Mawa did not meet the standards in the lab report. After that the adjudicating officer imposed a fine of three lakh rupees on the trader. Against the order of this fine, the businessman appealed in the district court. The appellant argued that the vessel in which the samples were taken was not cleaned properly. Mawa was bought, its selling price was not given in full. The side of the appellant was not even heard by giving notice. The order passed by the adjudicating officer against him is wrong. it should be repealed. It was argued on behalf of the department that there was no mistake in passing the order. The appellant was given full opportunity to present his case. The sample of mawa was found to be non-standard, it was kept for human sale. Therefore the appeal should be dismissed. After hearing both the sides, the court changed the amount of fine. The fine of 3 lakhs was reduced to 35 thousand rupees, due to which the trader got a big relief. It may be mentioned here that the court has reduced the amount of fine in such cases in the past as well.
