It has been seen many times that there are some cases in which an innocent person is implicated in false allegations. In one such case, Delhi High Court has given its decision which is noteworthy. Delhi High Court on Monday acquitted a person in the POCSO Act case. While releasing the man, the High Court said that there is lack and contradiction of evidence in this case. The High Court also said that the prosecution failed to prove the charges in the case.

The High Court said that just as being wrongly acquitted shakes people’s trust, being wrongly convicted is even worse. The case was heard by the bench of Justice Anup Kumar Mendiratta. Justice Anup Kumar said that the prosecution’s case is surrounded by lack of evidence and contradictions which cast doubt on the foundation of the prosecution’s case. The prosecution has completely failed to prove the charges in this case and has also left many doubts.
sentenced to 5 years imprisonment
The Court also sentenced the Appellant to 5 years’ imprisonment and imposed a fine of Rs 4000 for the offense punishable under Section 10 of the POCSO Act, 2012 and Section 506 of the IPC. Apart from this, the court has ordered the plaintiff to pay Rs 20,000 as compensation to the victim. Please note that in 2016, a case was registered under sections of POCSO and IPC at Jaitpur police station. In the case, the High Court further said that this case is based on tuition or fabricated story due to rivalry and marital disputes. It can also be seen that Padita refused to get the internal medical test done without any solid reason. The High Court further said that the victim, on her own discretion, also changed her statement regarding the acts committed by the appellant, which made the matter clear.
