New Delhi. The Delhi High Court on Friday issued notice to the Delhi Police on the bail plea of JNU scholar and social activist Umar Khalid. Khalid had approached the court after his bail plea was rejected by the trial court in connection with the alleged “big conspiracy” behind the Delhi violence.
Issuing notice in this matter, a division bench of Justices Siddharth Mridul and Rajneesh Bhatnagar said that the speech Umar Khalid made in Amravati was ‘offensive and objectionable’.
The bench posted the matter for further hearing on April 27, while ordering the police to respond within three days.
During the hearing, the court asked Khalid’s counsel about the speeches made by him.
The bench asked, “Did Gandhiji ever use this language? Did Shaheed Bhagat Singh ever use such language? We have no problem in allowing freedom of expression, but what are you saying?”
Earlier in the trial court, Khalid’s counsel had opposed the charges under the Indian Penal Code and UAPA, terming the chargesheet as a “work of fiction”. He had argued that the speech given by Khalid was about Gandhi, harmony and the Constitution, and was not a crime. After arguments, the court had reserved the order.
Opposing the bail plea, Special Public Prosecutor (SPP) Amit Prasad had argued on the relevance of the speech made by Umar Khalid in Amaravati in February 2020.
Last month, Additional Sessions Judge Amitabh Rawat refused bail to Khalid, observing that the allegations against the accused are prima facie true and there are reasonable grounds behind it.
Let us inform that Umar Khalid and many others have been booked under the Anti-Terrorism Act -UAPA for being the ‘mastermind’ of the Delhi violence of February 2020.
