The Allahabad High Court has directed a National Insurance Company to pay 33.50 lakhs in a road accident. The High Court while hearing said that the death of a person in the accident of a son is a big shock to his family. Along with this, the court said that the insurance companies cannot be linked to the matter of speeding every time in the death while driving. Every day some person dies in a road accident, one such case happened with a young man named Abhishek on 20 July 2004. He had died in a road accident. Compensation was claimed due to such death of Abhishek.
The court said that for any parent, the death of their son while alive is nothing less than a shock. We cannot even imagine their grief. Another mother lost her father and now her husband is no more, in such a situation how the woman must have been living her life, no one can imagine. Due to this, the court had directed the insurance company to pay the compensation amount. However, after the court’s direction, the insurance company told that the speed of the truck was high. To which the court said that reckless driving every time cannot be linked to speeding.
The court has directed the insurance company to pay the entire compensation amount along with 8 percent interest. The court said that even if the driver was driving the truck negligently, the insurance of the truck was taken. As a result, the insurance company should pay the appropriate compensation.
