The Karnataka High Court has given an important decision in the Hijab case. The court dismissed the petition of the girls saying that hijab is not an important part of Islam. A bench headed by Chief Justice Ritu Raj Awasthi delivered the important verdict. The court said that before giving this verdict, special attention was given to three questions. The petitions were dismissed only after finding their answers.
Those three questions are-
1- Is wearing hijab mandatory in Islam?
2- Does the introduction of uniform in schools and colleges violate fundamental rights?
3- The judgment delivered by the Karnataka High Court on February 5 violates Articles 14 and 15 of the Constitution. Let us tell you that on February 5, the court had said that no one will go to school and college wearing hijab until the final decision is taken.
The court gave answers to these questions-
1- Wearing hijab is not mandatory in Islam and it is not a necessary practice.
2- Implementation of dress code in school and college is not wrong and students cannot object to it.
3- The government has the power to give orders.
