The tussle between CM Uddhav Thackeray and Governor Bhagat Singh Koshyari in Maharashtra is well known. But a new twist came in this case when the Bombay High Court said in the remarks during the hearing that we know that both do not trust each other. Both have to clear their grievances for the sake of public interest. Otherwise the state will deviate from the path of progress.
In fact, the High Court was hearing two PILs filed by BJP leaders on Wednesday. In these, the rules related to the election of Speaker and Deputy Speaker of the Assembly were challenged. The court dismissed both the petitions and ordered forfeiture of the amount deposited on both sides. BJP leader Girish Mahajan had deposited Rs 10 lakh in the court and Janak Vyas had deposited Rs 2 lakh.
A bench of Justice Dipankar Dutt and Justice MS Karnik, referring to its order dated 21 August 2021, said that it is the constitutional duty of the governor to return the subjects approved by the cabinet within the stipulated time limit. Even if they have objections on that subject, keep in mind the time. The court then made this remark regarding the nomination of 12 members in the Legislative Council.
The court said today that we also work under a system of the constitution. But we are also being treated strangely. In the case of 12 MLCs, 8 months have passed since the order was passed but nothing has happened so far. Our orders are also not getting attention.
The court said that we are not saying who is wrong between the CM or the Governor. The CM is the executive head of the state. He has to see the whole state. On the petition of BJP leaders, the court said that such a petition has no meaning.
