parents remarried
A few days ago, a Muslim couple in Kerala got married once again to give their daughters full inheritance rights. Earlier they were married under Muslim i.e. Shariat law, this time they got married under the Special Marriage Act. Now his daughters will get full rights over the property. After this, there was a lot of discussion about the Special Marriage Act. People also came to know the flaws of Muslim law. However, Muslim clerics define it differently. Some people even started threatening this couple.
Earlier, when Swara and Fahad got married without changing religion, there was a lot of discussion about this law. This law gives the state the right to perform marriages other than marriages under personal law or religion. One of the major problems in personal law is that the religion of the bride and groom should be the same. If not, then there is talk of conversion, but if a Hindu or Muslim wants to marry without changing religion, then what is the option? In such a situation, the need for this act was felt. Under this, you can choose your life partner of other religion along with your religious identity.
No tension to change religion
By the way, both civil and religious marriages are accepted in the country. There are also some conditions in civil law. For example, the bride or groom should not already have a spouse at the time of marriage. There should be no one in the couple who is not in a position to give consent for the marriage. Must not be a mental illness.
After receiving the notice from the bride and groom’s side, within the next 30 days, any third person can file an objection regarding the marriage. During this a public notice is issued. One copy is displayed on the notice board and one copy is sent to both the parties by registered post. SDM looks into the objections received in 30 days and after that registration is done. If everything is fine then the process will move forward. Both the parties are present in the office and three witnesses sign. In this way the marriage officer gives legal recognition to the marriage.
Now demand for change in act
Under the Special Marriage Act, both the boy and the girl should be majors. They can be of any religion. The age of the girl should be at least 18 years and the age of the boy should be at least 21 years. Now a petition has been filed in the Supreme Court to make the Special Marriage Act gender neutral.
