Patna. The Nitish Kumar government, which is facing criticism over the prohibition of liquor, has decided to introduce the Bihar Liquor Prohibition Bill 2022 in the state assembly on Wednesday. Under the amendment, there is a provision for the first time offenders to get bail from the duty magistrate after depositing the fine. If the offender is not able to deposit the fine, he can be jailed for one month.
There is also a provision that when an offender is caught by the police for violating the ban, the accused has to mention the name of the person from where the liquor was obtained.
Nitish government will pass the bill in the assembly.
The Chief Minister of Bihar had imposed prohibition in the state in April 2016 under the Bihar Prohibition and Excise Act. Since the ban, a large number of people are lodged in jails only for drinking alcohol. Most of the violators are from economically weaker sections and poor people. Even in simple cases, the courts are taking a year to hear the bail.
Chief Justice of India (CJI) N.V. Ramana had said last year that the Bihar government’s decisions like prohibition in 2016 have put a heavy burden on the courts. The CJI said, “Three lakh cases are pending in the courts. People have been waiting for justice for a long time and now excessive cases related to alcohol violation are working as a burden on the courts.”
