New Delhi. Central investigation agency ED has filed an affidavit in the Supreme Court opposing the interim bail of Delhi Chief Minister Arvind Kejriwal. In its affidavit, the Supreme Court said that it is not right to grant interim bail for election campaign. Granting interim bail for election campaign is neither constitutional, nor legal nor a fundamental right. Anyway, Delhi Chief Minister Arvind Kejriwal is not even contesting the elections. Anyway, interim bail cannot be given even for contesting elections.
ED also highlighted in its affidavit that elections are held throughout the country throughout the year. If every leader is given interim bail only for the elections to take place, then it will be impossible to keep any leader in jail. In a federal structure, no election is less important than any other. Therefore, leaders at every level will start demanding interim bail in every type of election. These leaders will say that if they are not granted bail, the consequences for them could be serious.
ED said that many leaders across the country are in jail under the law made to prevent money laundering. Investigation into their cases is ongoing. Many leaders are imprisoned in the jails of the country under non-PMLA laws. Therefore, there is no point in giving special arrangement to any one person. This will also violate the constitutional right not to discriminate between people on the basis of any profession. This will clearly show that the work of a farmer, a businessman is less important for bail than the work of a leader.

In its affidavit, ED has also highlighted the fact that Delhi CM Arvind Kejriwal has not complied with the ED summons. ED said that Kejriwal kept making various excuses to avoid appearing before the investigating agency. Due to this, the ED investigation continued to be hampered. ED said that no leader is above any common man of the country, who needs any special arrangement to arrest or detain him for any crime.
