New Delhi. The Mamata Banerjee government of West Bengal has suffered a major setback due to an order of the Calcutta High Court. The High Court has canceled all OBC certificates issued by the West Bengal government since 2010. Under this order, about 5 lakh OBC certificates will be cancelled. On the other hand, Chief Minister Mamata Banerjee, reacting in this matter, said that she will not accept this order of Calcutta High Court.
However, in this case, the bench of Justices Tapobrata Chakraborty and Rajshekhar Manthar of Calcutta High Court has given relief to those people who have got jobs on the basis of these certificates. The bench says that this decision of the court will not affect the jobs given on the basis of OBC certificate made before 2010 or the ongoing recruitment process. While giving its verdict on a PIL, the court said that since 2011, the administration has issued OBC certificates without following the rules. Certificates issued in this manner are unconstitutional. The Court directed to prepare a new list of OBCs, as per the West Bengal Backward Classes Commission Act 1993.
Let us tell you that exactly a month before today, on April 22, the Calcutta High Court, in one of its orders, had canceled the recruitment of 25 thousand 753 posts of teachers and non-teaching staff in West Bengal in 2016, terming it illegal. Along with this, instructions were also given to these employees to return the salary received during 7-8 years of service. The court said that there was huge rigging in these recruitments. However, on May 7, the Supreme Court put an interim stay on this decision of the Calcutta High Court. The Supreme Court said that CBI should continue its investigation in the teacher recruitment scam, but should not take any action against teachers and employees. Now the next hearing of the case will be on 16th July.
