Bharat Rashtra Samiti (BRS) leader K. Kavitha, arrested in a money laundering case related to the Delhi Excise Policy ‘scam’, on Saturday filed a petition in a court in the national capital, seeking withdrawal of its order, in which the Central Bureau of Investigation CBI) was allowed to interrogate him in Tihar Jail. CBI is investigating the aspect of corruption in the excise policy case. Kavita’s lawyer Nitesh Rana told the court that the CBI had thwarted the due process of law by filing a petition seeking permission to interrogate her ‘behind her back’.

“I have serious apprehensions that the CBI may not have disclosed the true facts in order to obtain a favorable order from the court,” Rana said, urging the court to reconsider its Friday order allowing Kavita to be interrogated in judicial custody. The order should be kept in abeyance until their side is heard. The court heard the arguments and adjourned the case for hearing till April 10 after CBI sought time to respond to Kavita’s plea. However, special judge for ED and CBI cases Kaveri Baweja did not grant any interim relief to Kavita.

Rana later told PTI that even if the court did not withdraw the order, as per judicial discipline, the investigating agency should refrain from executing it as Kavita’s application is pending before the judge. Kavita was arrested by the Enforcement Directorate (ED) on March 15 from her Banjara Hills residence in Hyderabad in a money laundering case. The Telangana Legislative Council member had on Thursday requested the court to grant her interim bail because of her 16-year-old son’s exams. He said the son needed his mother’s ‘moral and emotional support’. The judge has reserved the decision on the petition for April 8.

Kavitha, daughter of former Telangana Chief Minister K. Chandrashekhar Rao, has been accused of being a key member of the ‘South Group’ that allegedly wooed the ruling Aam Aadmi Party (AAP) in Delhi in exchange for a major share of liquor licenses in the national capital. Actually a bribe of Rs 100 crore was given. He was sent to 14-day judicial custody last Tuesday.
