New Delhi. The Supreme Court will hold a special hearing on Saturday after taking suo motu cognizance of the allegations made by Calcutta High Court judge Abhijit Gangopadhyay against a colleague. Five senior judges of the Supreme Court, including Chief Justice (CJI) Justice DY Chandrachud, will hear the case at 10:30 am on Saturday.
In an unprecedented incident, Justice Abhijit Gangopadhyay accused his colleague, Justice Soumen Sen, who headed the division bench that stayed the single-judge order on the CBI probe into medical admission irregularities, of working for a political party .
The matter came after Justice Sen stayed an order passed by Justice Gangopadhyay, who had ordered a probe by the Central Bureau of Investigation or CBI into allegations of issuing fake caste certificates in Bengal. However, after Justice Sen’s division bench stayed his order, Justice Gangopadhyay took up the case again and ordered the CBI to investigate.
In his subsequent order, Justice Gangopadhyay not only ignored the Division Bench order, but also asked the Supreme Court to re-consider the orders passed by Justice Sen, on which he had accused him of working for a political party. is charged.
Justice Gangopadhyay said, “Justice Sen is clearly working for some political party in this state. Therefore, if the Honorable Supreme Court thinks so, then there is a need to re-think about the orders passed in cases related to the State. What has Justice Sen done today? He has saved some political parties in power in this state for his personal interest. Therefore, his actions clearly amount to misconduct.” Justice Gangopadhyay also questioned why Justice Sen continued to be a judge of the Calcutta High Court despite the Supreme Court Collegium recommending his transfer in 2021.
Justice Gangopadhyay in his order revealed the alleged private conversations between the judges. He alleged that Justice Sen called Justice Amrita Sinha to his chambers on the last day before the recent court holidays and told her that Abhishek Banerjee had a political future and he should not be harassed. Justice Gangopadhyay claimed that Justice Sinha reported the matter to the Chief Justice of Calcutta High Court, who in turn reported the matter to the Chief Justice of India.
Justice Abhijit Gangopadhyay has previously been reprimanded by the Supreme Court for talking to the press on cases he was hearing. He has often given statements which have been interpreted politically. Most of these statements are considered against the ruling Trinamool Congress in the state. TMC demanded that he should resign from the judiciary and join politics.
