The Supreme Court has ordered the release of Prabir Purkayastha, founder and editor-in-chief of Newsclick, who is jailed under UAPA. The bench of Justice BR Gavai and Justice Sandeep Mehta delivered the verdict. Purkayastha had approached the Supreme Court challenging his arrest under UAPA over Chinese funding to promote anti-national propaganda.
The court had raised questions on the arrest
Earlier, during the hearing on the petition of Prabir Purkayastha, the top court had raised many questions on his arrest. The court had raised the question that why did the Delhi Police hurry to produce Purkayastha before the magistrate after his arrest without informing his lawyer? The bench of Justice BR Gavai and Justice Sandeep Mehta had expressed surprise as to how the remand order was passed even before the remand application was given to Purkayastha’s lawyer.
The top court had reserved the decision
The bench, after hearing the arguments of all the parties, had reserved its verdict on Purkayastha’s petition challenging the arrest and remand in this case under the Unlawful Activities Prevention Act 1967, raising questions over the manner of arrest.
Was arrested in October last year
Prabir Purkayastha is accused of receiving funding from China to promote anti-national propaganda through the Newsclick portal. He was arrested in this case in October last year. He is in judicial custody since then. During the hearing, the decision was reserved after hearing the arguments of Purkayastha’s lawyer Kapil Sibal.
