new Delhi . The central government has told the Supreme Court that state governments, where Hindus or other communities are less in number, can declare them as minority communities in their area. The Ministry of Minority Affairs said in an affidavit: “It is submitted that State Governments may declare a religious or linguistic community within that State as a minority community. For example, the Government of Maharashtra has declared Jews as a minority. community within the state of Maharashtra.”
It also said that the Karnataka government has notified Urdu, Telugu, Tamil, Malayalam, Marathi, Tulu, Lamani, English, Konkani and Gujarati as minority languages within the state. “In addition, the states may also certify the institutions as minority institutions in accordance with the rules of the said state,” the affidavit said.
The ministry, however, responded to allegations made in a PIL by BJP leader and advocate Ashwini Kumar Upadhyay that followers of Judaism, Bahawi and Hinduism, who are minorities in Ladakh, Mizoram, Lakshadweep, Kashmir, Nagaland, Meghalaya, Arunachal Pradesh, Punjab, And Manipur cannot establish and administer institutions of its choice, that is not right.”
“It is submitted that matters such as declaring followers of Judaism.. Hinduism, which are minorities in Ladakh, Mizoram, Lakshadweep, Kashmir, Nagaland, Meghalaya, Arunachal Pradesh, Punjab and Manipur, establish and administer their educational institutions. Prescribing guidelines for the conduct of elections in the said State and identification of minority at the State level may be considered by the State Government concerned.”
