New Delhi. Senior advocate Dushyant Dave on Wednesday again appealed to Chief Justice of Jahangirpuri demolition case NV. Ramana, said that despite the apex court’s order, the municipal corporation has not stopped the demolition drive. However now it has been stopped.
Dave said the apex court order in the morning ordered status quo on the demolition, yet the municipal corporation did not stop the demolition drive in Jahangirpuri. He urged the top court to ask the general secretary to inform the North Delhi Municipal Corporation (NDMC), Mayor NDMC and Delhi Police Commissioner about the court’s order. “Once it’s widely reported in the media, it’s just not fair,” Dave said.
The Chief Justice asked the Registry to order the status quo order of the court on the demolition drive to be referred by Dave to the defendants in the case, the NDMC and the Delhi Police Commissioner.
Dave said the world is understanding that the top court has stayed the demolition, but the action is on. “It sends the wrong message,” he said.

Earlier in the day, the Supreme Court ordered status quo on the demolition drive being carried out by the municipal corporation against alleged encroachers in Jahangirpuri area.
Dave mentioned the matter before the Chief Justice and a bench headed by Justice Krishna Murari and Justice Hima Kohli. Dave said that this is a serious matter which requires immediate intervention of the apex court. “Completely unauthorized and unconstitutional demolition has been ordered in Jahangirpuri area, no notice has been given to anyone,” Dave said.
He further said that the authorities should have given at least five-six days’ notice to the people. Dave said it was supposed to start at 2 pm. But they started the demolition at 9 am, knowing that the matter would be placed before the court. The Chief Justice directed status quo on the demolition drive and agreed to list the matter before an appropriate bench for hearing on Thursday.
Senior advocate Kapil Sibal also referred to a petition filed by the Jamiat Ulama-e-Hind, questioning the legality of the demolition, initiated after riots in several BJP-ruled states, including Madhya Pradesh’s Khargone. The bench agreed to list it along with the Jahangirpuri case on Thursday.
