New Delhi. The Central Government has filed an affidavit in the Supreme Court regarding the appointment of Election Commissioners. The Central Government has opposed the demand to cancel the appointments due to not including the Chief Justice in the selection of Election Commissioners. The Central Government has opposed the applications seeking to stop the implementation of the Act, saying that the independence of the Election Commission or any other organization or authority is not in question, and it is not because of the presence of a judicial member in the selection committee.
What does the affidavit say?
The affidavit said the Chief Election Commissioner and Other Election Commissioners Act, 2023 protects the Election Commission as a supreme constitutional institution. It creates a more democratic and participatory legal framework for the functioning of the Commission, following the principles laid down in Supreme Court judgments.
‘There is no question on the qualification of election commissioners’
In the reply filed in the Supreme Court, the Central Government has said that the argument that the Commission will be independent only when there are judges in the selection committee is wrong. There is no question on the qualifications of the election commissioners. The purpose of this petition is only to create political controversy.
