An accused serving life term in a nearly 42-year-old case failed to get relief on Wednesday as the Supreme Court dismissed his appeal challenging the Allahabad High Court’s decision. The high court had in July 2018 dismissed his appeal against the lower court’s August 1983 judgment, which had convicted him and five others in the murder case and sentenced them to life imprisonment. Accused’s appeal dismissed
The Apex Court, while dismissing the appeal filed by the accused against the High Court’s decision, said that the appellant was taken into custody on September 9, 2019, after the High Court dismissed his appeal. A bench of Justice Indira Banerjee and Justice V Ramasubramaniam delivered the judgment on appeal against the July 2018 judgment of the High Court. The bench said that we find no ground to interfere with the findings of the lower court and the high court, therefore the appeal is dismissed. According to the prosecution, a complaint was lodged by the complainant in April 1980 alleging that a man had bought a buffalo from his elder brother Brahmpal Singh at a price of Rs 1900. He claimed that the buyer had promised Singh to pay the price of the buffalo, but he did not do so. The prosecution had alleged that later the complainant, Singh and others asked the buyer to clear his loan, but he along with his associates opened fire on them. Brahmpal Singh died in the firing incident.
