This petition has been filed by advocate Nalin Kohli. He has also mentioned in his petition the revelations made in the police investigation in the brutal murder of a six-year-old girl. According to the police disclosure, out of the four accused involved in the crime, two are minor children aged 8 and 11 and all of them were addicted to porn. Following this, the Assam Police issued guidelines for collecting digital evidence to the investigating officers during the investigation of cases related to rape, molestation and sexual offenses and asked them to follow them.
The petitioner sought a direction from the Supreme Court to the police organizations of all the states to collect data in a time bound manner on the direct link between viewing pornography material and rape cases. It also urged to consider framing of SOPs to include the aspect of viewing pornography material during investigation of rape and sexual assault cases.
The petitioner also requested the court to direct the state governments to immediately provide their police and investigative agencies the data related to this to BPRD. The petition said that the increase in cases of sexual assault and rape against women and innocent children in different parts of the country is worrying.
Instructions to implement wildlife management plan before mining around sensitive area
At the same time, the Supreme Court on Wednesday directed the Odisha government to implement a comprehensive wildlife management plan. Along with this, the top court also directed to complete the process of declaring the traditional elephant corridor as a ‘conservation reserve’ as per the provisions of the Wildlife (Protection) Act.
A bench of Justices L Nageswara Rao and BR Gavai said the implementation of the scheme should be as per the recommendations of the Standing Committee of the National Board for Wildlife before allowing any mining activity in the eco-sensitive area. The bench also directed the state to expedite the process of declaring the traditional elephant corridor as a ‘conservation reserve’.
The bench said that only after this permission would be given for mining operations of 97 mines. In fact, the Odisha government had challenged an NGT order stopping stone quarrying activities around the Similipal-Hadgarh-Kuldiha-Similipal elephant corridor in the Supreme Court. The state government claimed that there was no justification to stop the mining activity in that area as it does not fall in the eco-sensitive zone.
