Summary
This case dates back to the year 2000 when the constable was found sleeping by an officer in a watchtower of the National Thermal Power Corporation plant located in Kaniha. On reprimanding the officer, the constable attacked the officer himself.
The Supreme Court has upheld its 2001 order dismissing a CISF constable. The constable had allegedly attacked an officer when the officer found him sleeping while on patrol duty and reprimanded him. The Court observed that the spirit of integrity, discipline and harmony is paramount considering the nature of the force.
A bench of Justices Sanjiv Khanna and Bela M Trivedi delivered the verdict on a petition filed by the central government and others against the January 2018 judgment of a division bench of the Odisha High Court. The division bench, in its order, had confirmed the order of the single-judge bench setting aside the dismissal sentence awarded to the constable.
The top court said the dismissed person was a constable in the Central Industrial Security Force. It is a special police force that is responsible for providing security to the Department of Space, Department of Atomic Energy and strategic installations for the Indian economy. The bench had given this order on February 24, which was made available on Sunday.
