Vice President of Hindu Sena filed a petition
The petition, filed by Hindu Sena vice-president Surjit Singh Yadav, states that he is aggrieved by the election promises made by Congress, Samajwadi Party, Bahujan Samaj Party and Aam Aadmi Party in the current assembly elections. The PIL challenges the promises made by political parties to voters and the public during the assembly elections when their government comes to power. The petition has sought disqualification of all the candidates set up by the Congress and the Samajwadi Party in Uttar Pradesh and the Aam Aadmi Party in Punjab in the 2022 assembly elections.
Demand to register case against Congress, SP, BSP and AAP
The petition has sought directions to register an FIR against Congress, SP, BSP and AAP. It states that if these parties induce voters in Uttar Pradesh, Uttarakhand, Punjab, Goa and Manipur elections by offering gifts, goods, money from the exchequer, then Section 123(1)(a) of the Representation of the People Act, 1951 They should be booked for the offense committed under It has also been said in the petition that candidates who are found giving gifts free of cost should be disqualified from contesting elections.
The petition further argued that the Election Commission should be directed to evolve a mechanism at the time of filing nominations, wherein a declaration is made on behalf of the candidates to the effect that the political parties on whose behalf they are contesting have made a declaration. No offers and free gifts promised. If such declarations by the candidates are found to be false, such candidates should be disqualified from contesting the election and if they are elected, such election should be declared invalid.
