New Delhi. The Supreme Court on Tuesday granted bail to Aam Aadmi Party (AAP) leader and Rajya Sabha member Sanjay Singh in the money laundering case related to the Delhi liquor scam. Earlier, the Enforcement Directorate had said that it had no objection if Singh was granted bail in the case. The bail granted to the Rajya Sabha member has provided some relief to the Aam Aadmi Party during the Lok Sabha election campaign, whose national convenor and top leaders including Delhi Chief Minister Arvind Kejriwal and former Deputy Chief Minister Manish Sisodia are in jail in connection with the case. Voting for the Lok Sabha elections will be held in seven phases between April 19 and June 1 and voting in Delhi will be held on 25th. Counting of votes will take place on June 4.

Answer- Because the court had asked that Sanjay Singh has been in jail for 6 months, why should he be kept in jail even more?
Question- The Supreme Court said that if you oppose the bail, then we will have to consider his bail under the PMLA Act.
Answer- Granting bail under Section 45 of the PMLA Act would have meant that the court would have said that prima facie the allegations against Sanjay Singh are not proved. After this the liquor policy case would have weakened. Therefore, ED thought it better not to oppose the bail and bail was granted.

It has also been said in the copy of the written order of the Supreme Court regarding the bail of Sanjay Singh that the bail is being granted because the investigating agency ED did not oppose Sanjay’s bail. The Supreme Court has told Sanjay Singh not to mention his role in this case, which may affect the ongoing investigation.
Talking about the money laundering case of Aam Aadmi Party leader and former Deputy CM Manish Sisodia, the Supreme Court, while rejecting the bail plea, had said that the money trail is proved. However, the Supreme Court had said that if the trial is not completed soon then he can file the bail petition again. However, after the curative petition was rejected by the Supreme Court, a bail petition has been filed in the lower court. On this bail plea, Manish Sisodia argued that I am no longer influential, I am no longer the Deputy CM. Now the next hearing on Manish Sisodia’s bail plea will be held in Rouse Avenue Court on 6th April.
What did the court say while granting bail to Sanjay Singh?
A bench of Justice Sanjeev Khanna, Justice Dipankar Dutta and Justice PB Varale ordered the release of Sanjay Singh, who was in jail for six months. The bench said that no money was found from him. The bench said that AAP leaders can continue their political activities but cannot make any statement regarding this matter. The bench said that Singh will remain out on bail throughout the trial and the conditions of his bail will be decided by the special court. In the post-lunch session, Additional Solicitor General SV Raju, appearing for the ED, said he had taken instructions from the investigating agency and had no objection if Singh was granted bail. He said that I am giving the statement without going into the merits and demerits of the case.

Taking cognizance of the statement, the bench ordered that ASG SV Raju was asked to take instructions in the morning session. He has said that he has no objection if Sanjay Singh is released on bail in the proceedings related to the FIR. In view of the above statement, we allow the present appeal and direct that Sanjay Singh be released on bail pending trial on terms and conditions. The bench said that the bail granted to Singh would not be taken as a ‘precedent’.
Earlier in the morning session, the bench had asked Raju to seek instructions on whether the ED needed Singh’s further custody. The top court was hearing Singh’s bail plea and an appeal challenging his arrest and remand in a money laundering case. The bench told Raju that no amount had been recovered from him and the allegations of taking bribe of Rs 2 crore could be investigated during the hearing. Raju said he would respond to Singh’s arguments against his arrest and remand in the post-lunch session.
Senior advocate Abhishek Singhvi, appearing for Singh, said during the hearing that the AAP leader was arrested on the basis of the testimony of Dinesh Arora, who had turned government witness. Singh was arrested by ED on October 4 last year. He had sought bail in the High Court on the grounds that he has been in custody for more than three months and his role in the alleged crime has not been proven. The investigating agency had opposed the bail plea in the high court and claimed that Singh was involved in receiving, possessing, concealing, dispersing and using the proceeds of crime earned from the Delhi liquor scam relating to the excise policy period 2021-22 . ED’s money laundering case is related to the Central Bureau of Investigation (CBI) FIR. According to CBI and ED, irregularities were committed while changing the Delhi Excise Policy 2021-22 (now cancelled) and undue benefits were given to license holders.
