Delhi CM Arvind Kejriwal has been arrested in the liquor scam. ED will present Kejriwal in PMLA court tomorrow. Arvind Kejriwal has these options-
- Now after the arrest, the legal relief options available to Kejriwal will change. With the arrest of the Delhi CM now, the petition seeking protection will become ineffective. Now Kejriwal will have to challenge his arrest in the court.
- It is being told that after the arrest of Arvind Kejriwal, it is unlikely that he will get relief directly from the Supreme Court. His first option for legal relief would be to apply for bail. But for bail he will have to first approach the lower court.
- The other option for Kejriwal would be to challenge the arrest in the High Court or the Supreme Court, raising questions on the process of arrest. Let us tell you that Sanjay Singh had tried these options earlier. Sanjay Singh’s bail application is pending in SC after being rejected by the lower court and HC. Sanjay Singh’s second petition challenging the arrest is also pending in the SC after being rejected by the HC.
According to the recent decision of the Supreme Court regarding PMLA, ED has to tell the accused in writing what is the basis of arrest.
What is excise policy scam?
It is noteworthy that in the same case last week, former Telangana Chief Minister K. Chandrashekhar Rao’s daughter and Bharat Rashtra Samithi (BRS) leader K. Kavita was arrested by the agency from her residence in Hyderabad and is currently in ED custody till March 23 in the same case. The case pertains to alleged corruption and money laundering in the formulation and implementation of the Delhi Excise Policy for 2021-22. However, this policy was later canceled. AAP leaders Manish Sisodia and Sanjay Singh are in judicial custody in the case. Kejriwal’s name has been mentioned several times in the ED chargesheet. The agency alleges that the accused were in touch with Kejriwal to formulate the excise policy.
