New Delhi. The Supreme Court on Wednesday said that it is not avoiding considering the issue related to orders passed by various municipal bodies, especially in Mumbai and Kerala, regarding stray dogs, but it will not allow the scope of the matter under consideration to be expanded. The Supreme Court said that the parties should study the Animal Birth Control Rules, 2023 as it can resolve many of the issues raised earlier. Justice J. Of. A bench of Justice Maheshwari and Justice Sanjay Karol said, “Let us also make one thing clear.” We are not shying away from dealing with this issue but we will not allow its scope to expand.
The bench said that the 2023 rules are now in force and should be studied. A lawyer said that the bench may give him some time to study the 2023 rules. Another lawyer referred to an advisory recently issued by the Animal Welfare Board of India (AWBI) for the implementation of the 2023 rules and said, “If we all follow it, I can say that 90 percent of the problems will be solved.” will go”.

The bench said, “Please read the 2023 rules and advisories carefully.” After reading these 2023 rules, if most of the problems are being solved, then we can say in a few words that in view of the 2023 rules, officials can investigate the cases and deal with the problems as per the law. And if any problem arises even after that, the parties are free to approach the higher courts.
The court fixed May 8 as the next hearing date of the case. While hearing the petitions in September last year, the Supreme Court had said that it would not like to give any interim directions in this matter and it would take a decision only after considering the relevant laws, rules, their implementation and the issues raised earlier. A lawyer had said that different High Courts have given different views on this issue.
