New Delhi. In a major relief to the Delhi Metro Rail Corporation (DMRC), the Supreme Court on Wednesday set aside one of its own decisions and said that the public sector undertaking company ‘Delhi Airport Metro Express Private Limited’ will have to pay Rs 8,000 in compliance with the 2017 arbitration order. Not obliged to pay more than Rs. Crore.
A bench headed by Chief Justice of India DY Chandrachud accepted for consideration the curative petition filed by Delhi Metro Rail Corporation against the 2021 decision and said that the apex court erred in setting aside the decision of the Delhi High Court.
A division bench of the Delhi High Court had quashed the arbitration order passed against DMRC in 2019. “By setting aside the judgment of the Delhi High Court, this court clearly delivered a judgment which burdened a public undertaking with excessive responsibility,” the bench said in its judgment.
The bench said that the earlier decision of the apex court in this case amounted to a ‘mockery of justice’ and there was a need for reform. The decision said that the amount deposited so far by DMRC will be returned. The judgment restored the position of the parties to the same position as they were on the date of announcement of the Delhi High Court judgment.
The 2017 arbitration award was worth Rs 7,200 crore and with interest and other charges the amount rose to more than Rs 8,000 crore. The apex court had rejected DMRC’s appeal and review petitions challenging the decision to pay Rs 8,000 crore to DAMEPL.
