A Delhi-based FIR against Lashkar-e-Taiba founder Pakistani terrorist Hafiz Saeed, Hizbul Mujahideen chief Syed Salahuddin, Yasin Malik, Shabbir Shah, Masrat Alam and others in the J&K Terror Funding Case. The court has ordered framing of charges. These directions have been given on these accused under various sections of the Unlawful Activities Prevention Act (UAPA). They are accused of funding for promoting terrorist and separatist activities in the state of Jammu and Kashmir.
Special Judge Praveen Singh’s court at Patiala House Court has ordered Kashmiri politician and former MLA Rashid Engineer, businessman Zahoor Ahmed Shah Watali, Bitta Karate, Aftab Ahmed Shah, Avtar Ahmed Shah, Naeem Khan, Bashir Ahmed Bhat, alias Peer Saifullah and many others. Orders have also been ordered to frame charges against others under various sections.

The court, in its order, said that on the basis of the facts and evidence produced by the National Investigation Agency, the prima facie motive of creating alienation and spreading terror in Jammu and Kashmir of the accused in association with each other has been proved. Not only this, the investigating agency has also prima facie proved through documentary and other evidences of providing funds to terrorist organizations led by Pakistani terrorist organization to spread terror.
The court observed that during the arguments on the charge sheet, none of the accused had argued that they personally had no separatist ideology or agenda or worked for secession or separation of the erstwhile state of Jammu and Kashmir from the Government of India. did not advocate.
The court said that after going through the statements of the witnesses, it appears that after partition these terrorist organizations have the same objective that the state of Jammu and Kashmir should be separated from the Government of India. The court also noted that several witnesses have disclosed links between the All Parties Hurriyat Conference (APHC) and JRL to accused Shabir Shah, Yasin Malik, Zahoor Ahmad Shah Watali, Naeem Khan and Bitta Karate. The statements of another witness reveal that from Rashid to Zahoor Ahmad Shah Watali, there has been close contact with Pakistani terrorist organizations. The court said that this opinion is prima facie.
While framing the charges on the accused, the court said that all their remarks are prima facie after hearing the charge sheet. These should not be considered final. Now that these accused will be prosecuted, the decision which comes after detailed discussion on the evidence and hearing the prosecution and defense in detail will be final and valid.
Funding to spread terror: NIA
The National Investigation Agency (NIA) has alleged that the money for terror funding was channeled by Pakistan and its agencies and even diplomatic missions were used to fulfill erroneous designs. The court has also said that money was also sent for terror funding by declared international terrorists and accused Hafiz Saeed. According to the NIA, various terrorist organizations such as Lashkar-e-Taiba (LeT), Hizbul Mujahideen (HM), Jammu and Kashmir Liberation Front (JKLF), Jaish-e-Mohammed (JeM) with the support of Pakistan’s ISI, protect civilians and security. Violence was carried out in the valley by attacking the forces.
