New Delhi. Delhi CM Arvind Kejriwal has filed an application in the Delhi High Court against the arrest by ED. In this petition, he sought interim relief, but the court did not give any relief to Kejriwal on Wednesday. Now it has come to light why the court did not agree to give immediate relief to Kejriwal.
Delhi High Court has said that a decision on the release petition cannot be taken without considering the legality of the arrest. The court also said that if the decision is taken without taking a reply from the ED, then in a way it will be taking a decision on the main demand. Delhi High Court also said that the decision on release from custody will be like granting bail. The court can take a decision in this regard only after giving adequate opportunity of hearing to both the parties. Describing it as a matter of justice, the court also talked about giving adequate opportunity to all the parties. The court said that if ED does not get a chance to respond to the arguments of Arvind Kejriwal’s lawyers, it would be unfair to the investigating agency.
Delhi High Court also rejected the argument of Arvind Kejriwal’s lawyers that ED does not need to reply. The court said that ED’s response is needed to take any decision in this matter. Delhi High Court said that it will hear in detail before giving relief to Arvind Kejriwal. The court also said that it would be wrong to assume that the same arguments would be given by the ED as were given in the lower court. The court also said that Kejriwal is in the custody of ED. During this time, the investigating agency may have found new facts and evidence and can present these before the court. These new facts will prove important in the decision.
