New Delhi . The Delhi High Court on Tuesday sought a response from the Election Commission of India (ECI) on a Public Interest Litigation (PIL) within two weeks. A bench of Justice Vipin Sanghi and Justice Navin Chawla, hearing a petition filed by advocate and one of the founding members of Kamal Haasan’s political party Makkal Nidhi Maiyam (MNM), C. Rajasekharan, gave the Election Commission two weeks to respond in the matter. given time.
During the hearing, advocate Abhimanyu Tiwari appeared on behalf of the petitioner.
Last year, the court had issued a notice in the matter, in which the petitioner asked the Election Commission to prepare and notify a model procedure for elections with respect to intra-party elections.
The petition states that “the lack of internal democracy in political parties as opposed to other private organisations/institutions has a significant impact on the governance of the country, as the lack of transparency and internal democracy among political parties is often found in similar non-democratic governance models”. It is reflected when political parties come to power.”
However, various political parties among the registered parties do not necessarily conduct internal elections in the party and as such, no steps have been taken by the Election Commission to address the same.
It further states that the concept of democracy has been created to incorporate evolved standards of transparency and accountability, evidenced by the recognition of the right to information as an important right in an electoral democracy. The subsequent passage of the Right to Information Act and various Supreme Court judgments called for greater accountability and transparency in the electoral system, including finances in elections, information and adherence to political candidates, etc.
