Justice Arijit Pasayat, a former Supreme Court judge, is one of those who took advantage of the government’s amnesty scheme after Income Tax officials came to the fore about alleged ‘misreporting’ of income by him (former judge). Justice Pasayat is also the vice-chairman of the two-member SIT set up on black money. At the same time, the former judge says that why is the three-year-old case being taken up now when the matter has been resolved.
Following the first cabinet decision of the Narendra Modi government, Justice Pasayat was appointed in May 2014 to the SIT, which is headed by retired judge Justice MB Shah. Eight years later, the SIT on black money has submitted several status reports to the Supreme Court, which monitors its progress.
A year after he was ordered to falsely ‘report’ his income of Rs 1.06 crore in the 2017-18 financial year from the Cuttack unit of the Income Tax Department, that Justice Pasayat took advantage of the government’s amnesty scheme. This scheme which was started after the introduction of Direct Tax ‘Vivad Se Vishwas Act 2020’ was extended till 2021 and is called as VSV scheme. Section 6 of this elaborates that those who take advantage of it are exempted from proceedings in respect of an “offence”.

Government officials said Justice Pasayat paid Rs 37.90 lakh towards the ‘disputed’ tax of Rs 38.28 lakh under the VSV scheme. Under this provision, Justice Pasayat’s calculation of ‘disputed’ tax was done on the basis of the formula – 30% of additional tax added to income (Rs 31.94 lakh), 15% additional surcharge (Rs 4.79 lakh) and 3% education. and higher education cess (Rs 1.10 lakh) and interest under section 234 (Rs 43,616).
According to The Indian Express, when asked about this, former Supreme Court judge Justice Pasayat confirmed this and said that he had availed the VSV scheme in November 2020 and paid Rs 37.90 lakh. He added, “I don’t know how a private income tax order of 2019 got leaked? It may have been done by someone who may have been hurt by an order passed by me.” He said, “I had filed an appeal against the order, but then I was advised to pay the tax through the VSV scheme and close the matter. But why is the settled matter being taken up now?”
According to the order, for the year 2017-18, Justice Pasayat had declared his income from salary (from the government for his position on the SIT) to be Rs 26.85 lakh and from mediation and dispute resolution work to be Rs 3.66 crore. But, the order said, he had declared this amount under “income from other sources” and not as “professional income”.
