The best example of the type of churning used in both the Houses of Parliament under the Constitution of India to form a consensus vote for the public interest on a subject cannot be found in the country. Every MP has the right to participate in whatever laws are made by the Parliament for the country, to give his opinion on it. This constitution was made at a time when there was no development of road, rail, phone etc. But the members of the Constituent Assembly understood each and every citizen, each place and their every problem. Then there was a provision for brainstorming on how to solve them.
Due to all these beauty our country is progressing brightly and we proudly say that we have achieved a lot since independence. It is also true that the looters robbed us wholeheartedly, but the Indian stock could not be empty. In our country, we sit together and contemplate on every happiness and sorrow, we discuss it, then after distinguishing good and bad, they reach it in every nook and corner of the country.
It is said that unless the land is flat, water cannot be supplied to every corner of it normally and as a result the crop will not be the same. That’s why all the governments that came after independence, followed these rules after nineteen-twenty, successfully tested people to weave different types of flowers in a garland.
Chief Justice of India NV Raman and Prime Minister Narendra Modi participated in a joint conference of Chief Ministers of states and Chief Justices of High Courts held in New Delhi last week and deliberated on a serious topic to give a new direction to the country.
It is also said in India that due to the churning of the ocean, nectar was obtained. The subject on which this churning was organized was a very serious topic of the slavery period. The theme was- Justice should be in the language of the common people. In fact, even if a person is sentenced to death, then this thing is told by his lawyer. The person who is going to hang on the gallows does not understand that on the basis of which circumstantial evidence he has been given such punishment.
In this conference, Prime Minister Narendra Modi said that justice is the basis of governance in any country, so justice should be related to the people, should be in the language of the people. As long as the common man does not understand the basis of justice, for him there is no difference between justice and state order. The Prime Minister said that the courts need to promote local languages; Because it increases the trust of the common man in the justice system.
The Prime Minister’s statement that justice should be quick, accessible as well as for all is heart touching. Regarding the trust of the common man on justice, then the truth is that even a very ordinary person gets caught in the trap of bureaucracy or gets oppressed by the tyranny of musclemen. The only challenge he challenges is that ‘we believe in justice, so we will see it in court.’
The result of this conference was that the work of Vidhi Sahitya Prakashan, established in the year 1968, is to translate the decisions given by the Supreme Court and the High Court in English. So far fifty thousand judgments have been translated.
The Chief Justice of the country NV Raman made it clear that the judiciary will never come in the way of governance, but only if it is according to the rules, that is, according to the law. The Chief Justice said that the government is the biggest litigant, so it creates a new category by increasing the contempt case due to non-implementation of the orders of the court for years. It is not good for democracy not to take steps despite the order of the court.
He also enumerated some of the reasons for the plethora of cases in the courts. Giving an example, he told that if the Tehsildar takes action on the complaint of the farmer regarding the survey of land or the ration card, then why will the farmer come to the court? If gram panchayat and municipal corporation function properly, why should citizens look at the court? If the revenue department acquires the land following the law, then there will be no burden of litigation.
Most of the cases are like this. At the same time, Prime Minister Narendra Modi, referring to the increasing use of technology in the judicial system, said that the e-court project is being implemented in mission mode. The work of technological integration and digitization in the judiciary has progressed rapidly. The Prime Minister also urged the judges and chief ministers to give special importance to this campaign.
The Prime Minister also requested to consider the bail of 3.5 lakh undertrial prisoners lodged in the jail, saying that most of them belong to poor or normal families. He suggested that every district of the country should have a committee under the chairmanship of the district judge, so that all these matters could be reviewed. At the same time, he urged the Chief Justices and Chief Ministers of the High Court to give priority to this if possible, keeping in view the humanitarian grounds and the law.
The Chief Justice of India NV Ramana stressed on the need for Indianisation of the judicial system and the need for proceedings in vernacular languages in the High Court. The Chief Justice said that he had received several memorandums regarding proceedings in local languages in the High Courts. He said that he felt that the time had come to consider this demand and take it to its logical conclusion.
On this, the Prime Minister appreciated the Chief Justice for giving the decision in this local language. He praised the Chief Justice of India and said that I liked that he himself chose the subject. Talking about the government’s efforts on the matter, the Prime Minister said that there is a need to simplify the legal language and there is a need to make efforts in that direction. In this context, he gave a new information that in our country also there should be a complete vocabulary of law, which is also understandable to the common public.
Both these things should be passed simultaneously in the Legislative Assemblies and MPs, so that later the common man can make his point on its basis. The Prime Minister said that this is a tradition in many countries, for which India has also formed a committee.
The former Prime Minister of the country, Mr. Rajiv Gandhi used to say that the government pays full attention to its plan, but it is important to know how far the benefits of that scheme reach the last person standing in the queue. There is no shortage in the thinking of the Prime Minister. If there is a shortage, then that intention, that confidence, on the basis of which we can reach the maximum benefit of any beneficial scheme to the last person standing in the queue.
Whatever was discussed in this conference, whatever plans were made, it is the best thinking for the public interest. But, the question is, by when will this scheme be passed by the Legislative Assemblies and MPs and become a law, then when will it be implemented.
Till now, it has been the case that innocents end their lives inside the bars for years without being sentenced. As the Prime Minister said before the Chief Justice of India, there is no need to repeat the sad aspect of the Indian judicial system that jailed lakhs of people without sentencing them. Whatever has been happening till now, even if we ignore it, then what will be the guarantee that it will not happen in future.
It is true that India is a huge country. There are many languages here. Quickly end the old situation and start tomorrow with the new situation, it cannot happen. It will take time, but planning must start first.
The big challenge is that everything will happen, but only when the whole country wants it. But, until our society is not educated, we will remain backward and will not be able to progress on any path without fear. Our society is not fully educated. First of all we have to educate the society.
This should be considered because there are not so many inequalities in developed countries. India has developed only after independence, but not in the same proportion as the developed countries of the world like America, Japan. Apart from this, there are many such countries in the world where there is a provision of free education. They believe that unless we are educated, our country will not be able to develop. There are many states in our own India, where education is 100%.
Therefore, the growth rate of the country is also highest there. Apart from every citizen, the main responsibility of the government is to educate the society. If the society develops, then the law and order will automatically change. Now it is to be seen how fast the Government of India pays attention to its development with the aim of making the society aware so that the law and order system in the society is completely controlled.
