Summary
CJI Dutta asked the Maharashtra government, what are you doing? It is completely illegal. You are not following the law. It is clear in the law that unless the state government has rules, the guidelines of the central government will have to be followed. The companies providing cab services will have to follow this.
The Bombay High Court in an order on Monday directed all Ola-Uber cab drivers in Maharashtra who do not have a valid license to apply for a license by March 16. The court held that driving a cab without a license was completely illegal and said that if the services are to continue, then the cab drivers will have to get a license.
A bench of Chief Justice Dipankar Dutta, however, did not restrain such cab drivers from driving during this period as doing so may cause hardship to the large population traveling by cabs on a daily basis. The bench was hearing a PIL filed by advocate Savina Crasto. The petition raised the issue of lack of an effective grievance redressal mechanism for customers using the Uber India app.
