new Delhi. The Supreme Court on Friday said that it is necessary to educate and promote the youth of Kashmir.
The top court observed that everyone makes mistakes in their youth, but it is necessary to educate the youth and move forward.
Hearing a petition by the Union Territory government challenging the order of the Jammu and Kashmir High Court, which had directed the Jammu and Kashmir Women’s Development Corporation to release more loan installment to Mubashir Ashraf Bhat, Justice D.Y. Chandrachud and Suryakant said, “We need to promote the youth of Kashmir by educating them.”
It said that if he quashes the order of the High Court, it will have a negative impact.
During the hearing, Advocate Taruna Prasad, Standing Counsel for Jammu and Kashmir, argued that the matter should be heard as there has been a breach of trust in the matter. To this, the bench said that Bhat may have committed a mistake, but it can be ignored in this case.
The top court said that admit there is a mistake on their part, but we all have made mistakes in our youth. The court noted that if the appeal is allowed, it may result in voiding of the credit resources available to the Kashmiri youth and thus the court refused to entertain the appeal.
Initially, the Corporation released the first installment of loan in favor of Bhat, however he was denied the latter installment for changing his admission from Community Based Medical College, Bangladesh to Khwaja Yunus Ali Medical College, Bangladesh without informing the Corporation Gone.
A single-judge bench of the High Court had ruled against Bhat, but a division bench ruled in his favor. The Union Territory challenged this order in the apex court.
The corporation had demanded refund of the first installment of the loan released to Bhat and refused to sanction the subsequent installment. Bhat moved the high court challenging the decision, observing that he was forced to change his admission due to non-availability of seats in a community-based medical college.
