Chief Justice NV Raman on Friday said a new trend has started here, the government has started defaming the judges and it is unfortunate. The CJI, who is presiding over the three-judge bench, said, “We are looking into the court as well. Now a days a new trend has started. Earlier we used to see private parties adopting such tactics. Now we are seeing this every day.”
The remarks came when a bench of Justices Krishna Murari and Hima Kohli was hearing an appeal against an order of the Chhattisgarh High Court against Aman Singh, principal secretary to former chief minister Raman Singh, and his wife Yasmin Singh, under the Prevention of Corruption Act. The FIR registered under was dismissed in 2020. The case was dismissed after the BJP government was out and the Congress party came to power in the state.
The Economic Offenses Wing of the state police had registered an FIR against him on 25 February 2020 on the basis of a complaint lodged by Sahiksha Sharma, a social and anti-corruption activist. Aman Singh and Yasmin in the complaint written by proper Sharma to the Chief Minister
He had demanded a probe into the assets allegedly disproportionate to the earned income.
On February 28, 2020, the Chhattisgarh High Court in an interim order directed that no coercive action be taken against the two. By order dated January 10, 2022, the HC quashed the FIR holding that “all the allegations made against the petitioner are prima facie based on probabilities and no person can be prosecuted on the ground of likelihood”.
The High Court also underlined in its order that the Chief Minister himself had supported the complaint of the appropriate Sharma, so get it investigated by the CS / EOW. After this a preliminary inquiry was started against Aman Singh on November 11, 2019. Both Sahiksha Sharma and the state government challenged the High Court’s decision before the Supreme Court. Considering the appeals, the CJI was apparently upset and made this remark. However, it was not clear why the court was upset and commented that the government was defaming the judges and that this is a new trend.
