People in India often flock to shopping malls to entertain themselves, and while paying parking fees is a common practice in malls across the country, it now seems that the cost of parking can be waived. In fact, while hearing a petition related to parking fee, the Kerala High Court recently said that it is not proper for malls to charge parking fees.
The Kerala court had received several petitions against the recovery of parking charges by the state’s Lulu International Shopping Mall. In which it has been alleged that the collection of parking fee by the mall is illegal. Hearing the matter, Justice PV Kunhikrishnan sought the opinion of the Kalamassery Municipality on the matter and now the petition will be taken up for consideration after two weeks.
Parking fee illegal in the eyes of the court
The court asked, “As per the building rules, parking space is a part of the building, and building permit is issued on the condition that there will be parking space. A building is constructed on this basis. After construction what owner Who can collect the parking fee, that is the question. I am of the opinion that it is not possible, so the court wants to know the stand of the municipality on this issue to get to the bottom of the matter.”
In the petition received by the court, it was alleged that Lulu Mall was collecting the parking fee without any authority. After hearing both the sides, the Kerala High Court directed the municipality to record a statement mentioning their stand on the parking charges collected by the malls for the mandatory parking space under the building rules. The matter will now be heard in the court on January 28, 2022.
