New Delhi. It seems that the elections for MCD Mayor and Deputy Mayor will not be held until Delhi CM Arvind Kejriwal comes out of jail. Lieutenant Governor VK Saxena has asked the current mayor and deputy mayor to continue in office till the next elections. The Lieutenant Governor said that the appointment of the presiding officer for the mayor election is very important and the appointment of the presiding officer cannot be done without the opinion/suggestion of the Chief Minister. Lieutenant Governor Saxena said that according to the information received from the Chief Minister’s Office, the office is unable to send the file containing the appointment of the Presiding Officer to the Chief Minister and communicate with him.
It has been told that only Chief Minister Arvind Kejriwal can send the file sent by the Chief Secretary to the Lieutenant Governor with his opinion. No minister can give his opinion on this. On April 22, the Chief Secretary had sent the file to the Chief Minister’s Office regarding the appointment of the Presiding Officer. The Chief Minister’s office returned this file saying that the Chief Minister is still in judicial custody. In such a situation, the Chief Minister’s Office is not in a position to send this file to the Chief Minister or establish communication in this regard.
Under Section 77A of the DMC Act, the Chief Minister sends the file related to the subject to the Chief Secretary to the Lieutenant Governor. Besides, the GNCTD Act also says that only the opinion of the Chief Minister on any subject matters. Urban Development Minister Saurabh Bhardwaj has said in a note sent to the Lieutenant Governor that as the Chief Minister is in judicial custody and cannot play his role in the selection of the presiding officer. The minister is demanding to take his own decision in this regard. In such a situation, it is not clear under which constitutional and legal provision of the GNCTD Act the minister is asking to do this.

Lieutenant Governor VK Saxena has written in his note that I do not consider it appropriate to use my power as an administrator to appoint the presiding officer without the input of the Chief Minister. Therefore, according to the DMC Act, the current Mayor and Deputy Mayor should continue on their posts until the Mayor elections are held in the future. The Lieutenant Governor of Delhi has sent this note in response to the file sent by the Chief Secretary and the note written by Saurabh Bhardwaj.
