new Delhi. The Supreme Court on Monday issued notice to RJD President Lalu Prasad on a CBI plea against two orders of the Jharkhand High Court granting bail in the multi-crore fodder scam case. The CBI has challenged the orders of the Jharkhand High Court on April 17, 2021 and October 9, 2020.
Justice L. Nageswara Rao and Justice B.R. Gavai issued notices in both the cases.
During the hearing, the bench said that the High Court says that Lalu Prasad had already served half of the sentence, so he has followed the 50 percent rule.
Representing CBI as Additional Solicitor General, S.V. Raju said the rule would not apply in light of the fact that the sentence was to be continued. The bench asked, “What is the punishment? .. How much period has been spent?”
He said this was contrary to the provision under Section 427 of the Code of Criminal Procedure, which stated that the subsequent punishment would commence only after the first conviction was awarded.

In April last year, the High Court had granted bail to Lalu Prasad in the case of fraudulent withdrawal of Rs 3.13 crore from Dumka treasury. The High Court said that he has completed half the term of the sentence. And, in October 2020, the High Court had granted bail to Lalu Prasad in the fodder scam case involving illegal withdrawal of funds from the Chaibasa Treasury.
Lalu Prasad was convicted in four fodder scam cases for fraudulent withdrawal of money from Jharkhand’s Deoghar, Dumka and Chaibasa treasuries.
In March 2018, a special CBI court had sentenced Prasad to 14 years in jail in the Dumka treasury case.
