Let us tell you that Indore High Court had ordered ASI to survey the Bhojshala. At that time the petitioner Qazi Moinuddin was not a party in the High Court.
The Supreme Court said that the petitioner Qazi Moinuddin, who is the mutawalli of Kamal Maula Masjid, was not a party in the High Court. After this the petitioner Qazi Moinuddin withdrew his petition.

It is worth noting that earlier on Monday also the Supreme Court had refused to hear a petition seeking ASI survey of Bhojshala. However, the Supreme Court had also said that without its permission, no action would be taken based on the results of the survey. After hearing the arguments of the petitioner’s lawyer, the Supreme Court issued notice to the Central Government, State Government and ASI and directed them to file their reply within 4 weeks. It was also made clear that no excavation would be done during the survey, which would change the nature of the complex.
