new Delhi. A court here has acquitted three accused in the 2020 Delhi riots case, saying “even if charges are framed against them, it will be a waste of judicial time”.
Additional Sessions Judge Virendra Bhat of Karkardooma Court in North East Delhi observed that even though the evidence produced by the prosecution against these accused is not contradicted during the trial, the rules laid down by the Supreme Court judgment in Masalati’s case their sentence cannot be ordered in view of the statute that mandates that there must be at least two prosecution witnesses to identify the role and involvement of the accused in the incident under consideration.
The court, in its April 2 order, said, “The charges cannot be framed against these accused keeping in view the material annexed to the charge sheet, on the basis of which there is no 10/10 probability of their punishment at the final stage.” It would be a waste of judicial time.”
The court observed on the basis of weak evidence that it would be a waste of time to continue the trial in the matter.
The court further observed, therefore, there is no sufficient evidence on record on the basis of which charges can be framed against these three accused. Accordingly, they are liable to be discharged.
According to the police, the three accused – Nitin, Shyam and Shiva – have been booked under Indian Penal Code sections 308 (attempt to commit culpable homicide), 147 (rioting), 148 (rioting, armed with deadly weapon), 149 (unlawful assembly manner). Assembly) and the charge sheet has been filed under section 27 (punishment for use of weapon) of the Arms Act, 1959.
