Delhi High Court first reprimanded MCD and DDA.
Seeing the seriousness of the case, the court ordered a CBI investigation.
New Delhi. The Delhi High Court ordered the CBI to investigate illegal construction done in a sealed building near the protected monuments of Nizamuddin Ki Baoli and Barakhamba Tomb in Delhi. The bench of the Acting Chief Justice expressed surprise at the fact that such activity was carried out in the heart of the city and the authorities failed to stop it. The court said, an illegal building as big as a five-storey building has come up in the middle of the city… despite many authorities, illegal construction on such a large scale is going on in Delhi, which was never heard of or seen before.
The court said that although the Delhi Police had registered an FIR, it would be appropriate that it be transferred to the CBI for proper investigation. The court also stressed on improving the functioning of Delhi Municipal Corporation and Delhi Development Authority to deal with the issue of unauthorized construction. Also directed to invent new methods to deal with encroachment and unauthorized construction in the city.

DDA and MCD commissioners have been ordered to hold a meeting on this issue and place the minutes of the meeting before the court. The court passed the order after hearing a PIL filed by Jamia Arabia Nizamia Welfare Education Society seeking investigation against officials of the Archaeological Survey of India and DDA.
DDA-MCD blame each other
The petition said that the construction has been done barely a few meters away from ASI protected monuments. MCD told the court that the allegedly illegal guest house is located on DDA land. On the other hand, the DDA argued that it was the duty of the MCD to enforce the rules as per the building clause in the area and remove illegal encroachments. Meanwhile, the Delhi Waqf Board claimed that the land on which the property is situated is theirs. DDA had opposed this.
