The Supreme Court said, “It is very clear that the petitioner’s wife was pregnant. Hence she went to her parents’ house. It was natural. The petitioner’s wife has also clarified that her pregnancy and child birth took place with great difficulty.” In such a situation, if she decided to live with the parents for some more time after the birth of the child, then it should not bother the husband. How can the matter be taken to the court for divorce on this ground alone?

On behalf of the wife, it has been argued in the Supreme Court that I had been with the parents due to pregnancy, but the husband did not wait a bit. He did not even think that he had become the father of a child. Ignoring the fact that his wife’s father passed away and he filed a petition in the court for divorce.

Despite this, the Supreme Court approved the relationship between the couple because their marital relationship is now dead. Both have been living separately for more than 22 years and the husband had also remarried. In such a situation, the Supreme Court also agreed that it would be better if this relationship is considered to be over. The court asked the petitioner to pay a compensation of Rs 20 lakh to the ex-wife.
The whole matter of Tamil Nadu
An appeal was made to the Supreme Court against the decision of the Madras High Court. This case is of Tamil Nadu, in which the petitioner got married in 1999. Shortly after this his wife went to her parents when she became pregnant. There their child was born in August 2000. His father passed away in February 2001. Because of this she could not return to her in-laws’ house for some more time. On this basis, the husband filed for divorce in the family court. Also married for the second time in October 2001.
