At present, the issue has arisen in Rajasthan that how all the 6 accused, including Gauhar Chishti, the Khadim of Ajmer Sharif Dargah, who raised slogans of ‘Sir Tan Se Juda’ in Ajmer, were acquitted? 6 people including Gauhar Chishti were acquitted by the Ajmer court on Tuesday due to lack of evidence. Gauhar Chishti was released from jail on Friday. The Ajmer court said in its order that the police could not present concrete evidence to prove the allegations. After being acquitted, Gauhar Chishti said that he was framed under a conspiracy, but the court did justice to him. Gauhar Chishti was accused of spreading hatred in the society and inciting people to violence on the basis of a video. This video is of June 17, 2022. On that day, Gauhar Chishti addressed a crowd of about 20 thousand people at the main gate of Ajmer Sharif Dargah. In this video, Gauhar Chishti can be clearly heard standing on the stage and making the crowd shout slogans of ‘Sir Tan Se Juda’. This video was shot by a policeman. 8 days later, on June 25, a complaint was filed by a police constable Jai Narayan.

There is no doubt that slogans of ‘Sir Tan Se Juda’ were raised. Police presented 22 witnesses in the court to prove this allegation but none of them was a common man. All of them were policemen. Police presented the video in the court but did not get it forensically examined. They did not even confiscate the phone of the police constable with which this video was made. That is why the court acquitted all the accused due to lack of evidence. Since this case is from the time when Ashok Gehlot’s government was in power in Rajasthan, BJP leaders have alleged that the police deliberately weakened the case on the instructions of the government. Chief Minister Bhajanlal Sharma is also angry over the release of Gauhar Chishti. The Chief Minister has reprimanded the Ajmer administration for being lax in the investigation, although the government lawyer is not raising questions on the investigation. Government lawyer Virendra Singh Rathore said that there was all the evidence against Gauhar Chishti, he is clearly seen raising the slogan ‘Sir Tan Se Juda’ in the video, but the court did not accept his arguments. Rathore said that he will now go to the High Court against this decision. Gauhar Chishti had absconded after the incident. The police arrested him from Hyderabad.

Nasir, who hid Gauhar Chishti in Hyderabad, is also an accused in this case but the police could not prove his crime. Gauhar Chishti is claiming that he did not run away, he had gone to Hyderabad for a visit. The interesting thing is that the police also had a picture of Gauhar Chishti with Nasir but the court did not consider it as evidence. Nasir has also been acquitted in this case. There is no doubt that the Rajasthan Police was negligent in investigating this case, deliberately made the evidence disappear, weakened the case. The police does not need to tell that the mobile phone from which the video was shot is seized for forensic investigation. Instead of doing so, the police transferred the video to a CD and deleted the video from the phone. When the court asked the public prosecutor where the original video was, he was told that it had been deleted. The court asked where the phone in which the policeman had shot the video was, it was said that the phone had got damaged, it was lost. The court asked, slogans were raised in front of the crowd but why are all the witnesses policemen, why the police could not find even a single independent witness, there was no answer. That is why the court acquitted all the accused. Now it is important to know whether what the police did was done by the local police on its own level or was it given instructions from above to weaken this case. It should also be known whether this is the failure of the police or a well thought out political decision, for which the support of the police was taken. (Rajat Sharma)
