Hearing in Supreme Court on infiltrators in India, CGI said, 'Should we spread the red carpet for them?

New Delhi. The Supreme Court heard the issue of infiltrators on Tuesday. During this, Supreme Court Chief Justice Surya Kant made a sharp comment and said that infiltrators will enter and then demand rights. Should we roll out the red carpet for intruders? A bench of Chief Justice (CJI) Justice Surya Kant and Justice Joymalya Bagchi was hearing a habeas corpus petition. It has been alleged in the petition that in the month of May, Delhi Police detained some Rohingya persons, after which there is no trace of them. Also, the petition demanded that if they have to be returned to their country, then this process should be according to the law. The petitioners wanted the central government to share information related to the detention and expulsion of these Rohingya. Solicitor General Tushar Mehta, appearing for the central government, opposed this.
“We have a very sensitive border on the North Indian side, and hope you all know what is the situation going on inside the country,” the Chief Justice said.
He said, “You want a red carpet to be rolled out for them? They should enter through the tunnel and then demand rights like food, shelter, education of children?”
Chief Justice Surya Kant said, do we want to stretch the law like this? Don’t our poor children deserve these facilities? It is very speculative to seek Habeas Corpus in such cases.
The Supreme Court refused to hear the petition. The court said to come again for hearing on 16th December. Along with this, the court has also refused to issue notice.
The Supreme Court also raised questions on Rohingya being called refugees and asked whether infiltrators can be given refugee status? He asked, “Can someone be given the right to live in India if he infiltrates into the country?”
The petitioner’s lawyer said that she was neither demanding special rights for the Rohingyas nor demanding anyone’s return. The sole purpose of the petition is to get the government to follow its own deportation process.
He said that the court has already said in the Salimullah case (2020) that Rohingyas can be sent back only when the process is according to the law.
Let us tell you that in the same year, in another case related to Sri Lankan Tamil refugees, the Supreme Court had said that India cannot become the hospice of the world, where refugees are accepted from all sides. Additionally, the court had also commented in another petition in May that the story of throwing Rohingyas into the sea sounds like a calligraphic tale.
