New Delhi. The Supreme Court on Monday said the Central Board of Secondary Education (CBSE) should look into the problem of students who appeared in the examination this year to improve their class 12 marks but scored less as it could lead to admission for higher studies. They will be impressed even if they make a place in. The top court said that the students appearing in the reform examination have taken admission on the basis of their original results and there should be no hindrance in this.
Justice A.M. Khanwilkar and Justice CT Ravikumar was informed that the CBSE has filed a counter-affidavit. It said that the students who have failed in the subsequent improvement examinations will be considered for the previous examination results and they will have the opportunity to retain the same.
The counsel appearing for the petitioners told the bench, “The problem is only with those students who have secured lesser marks in the improvement examinations. Such students have also taken admission on the basis of their previous examination results. Therefore, such students should be given freedom to retain their original result which was issued on the basis of evaluation policy.”
The top court was hearing a plea by some students who appeared in the reform examination this year to improve their marks in CBSE’s class 12 examinations. The petitioners have requested for a direction to the Board to retain its original results. The bench told the counsel appearing for CBSE that such students, who have secured low marks in the reform examinations, who have taken admission on the basis of their original marks, would have an immediate effect on their admission.
The bench told the counsel for CBSE, “You have to consider it. This is a one time arrangement only. This is not a permanent policy.” On this, the lawyer said that he will take instructions on this aspect. The court further said, “You either say yes or no. Otherwise, we will issue instructions. Entry should not be obstructed. That’s all we will say.”
The top court asked the counsel for the board whether they had discussed the issue with the authorities concerned as it would be a problem which the students appearing for the reform examination would have to face. CBSE’s counsel said that he would take instructions on this, after which the bench fixed the matter for hearing on January 7.
