New Delhi. The Allahabad High Court, while hearing a woman’s petition, has made a very important remarks about the sexual relationship formed during the love affair. The single bench of Justice Arun Kumar Singh Deshwal said that if a woman is not possible to marry a lover for social reasons, yet it makes a physical relationship with consent for years, then it cannot be called rape. With this, the court dismissed the petition filed on behalf of the woman. The woman accused her colleague of rape by promising marriage.
The woman accused her colleague Lekhpal in 2019 in Charkhari police station area of Mahoba district that she called her on the pretext of a birthday party and raped her by feeding drugs and also made a video of her. According to the victim, when she came to her senses, the accused promised to marry her. However, after four years, the marriage refused due to caste reasons. The woman said that earlier she lodged a complaint with the police but after no action was taken, she filed a complaint in the special court of SC-ST. But the special court did not consider it a case of rape and dismissed his petition. After this, the woman appealed to the Allahabad High Court but she did not get any relief from there either.
The court said that the woman and the accused were in love affair for a long time and there was a physical relationship between the two. Now if a woman knows that marriage is not possible due to social causes or other caste obstacles and despite that she voluntarily maintains a relationship for years, then she cannot be seen as a rape. On the other hand, the lawyer of the accused told the court that when he asked the woman back two lakh rupees, a case of rape was filed against her.
